Terms of Service

These Terms govern use of youroperative.com and related Operative communications. Paid client engagements may also be covered by a separate Service Agreement.

1. Company

These Terms are between you and Operative LLC (“Operative,” “we,” “us”). Brand names include Operative and Your Operative.

2. Services

Operative provides digital marketing and operations services for local businesses, which may include websites, local SEO / Google Business support, lead capture, CRM automation, missed-call text-back, booking systems, review generation, AI phone receptionist services, and related consulting. Specific deliverables, pricing, and terms for paid plans are described on the site and/or in your Service Agreement.

4. No Guarantee of Results

We deliver professional work and systems. We do not guarantee specific rankings, lead volume, revenue, call answer rates, or other outcomes. Results depend on market conditions, competition, platform policies, and factors outside our control.

5. Communications Consent

By submitting your phone number or email through our website, chat, booking form, or by requesting contact, you consent to be contacted by Operative about your inquiry via phone, SMS, and email. SMS details and opt-out instructions are in our SMS Messaging Policy. Privacy practices are in our Privacy Policy.

6. Intellectual Property

Unless otherwise agreed in writing, Operative retains ownership of its templates, systems, software, processes, and brand assets. Client-owned materials remain the client’s. Website ownership and deliverable transfer for paid clients are governed by the applicable Service Agreement.

7. Third-Party Platforms

Our services may integrate with third parties (Google, Meta, CRM/telephony providers, hosting, payment processors, etc.). We are not responsible for outages, policy changes, suspensions, or actions by those platforms.

8. Payment (Paid Services)

For paid plans, fees, billing, cancellation, and payment-method requirements are set out in your Service Agreement / Service Menu. Unless otherwise stated, plans are month-to-month.

9. Limitation of Liability

To the maximum extent permitted by law, Operative is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Our total liability for claims arising from website use or services is limited to the fees paid to Operative in the 30 days preceding the claim (or $100 if no fees were paid).

10. Indemnity

You agree to indemnify and hold Operative harmless from claims arising out of your misuse of the site, inaccurate information you provide, or your violation of these Terms.

11. Dispute Resolution

Before formal dispute proceedings, contact us and allow 30 days for informal resolution. These Terms are governed by the laws of the State of California. For paid client Service Agreements, arbitration and venue provisions in that agreement control where applicable. Otherwise, exclusive venue is in the state or federal courts located in Alameda County, California.

12. Changes

We may update these Terms by posting a revised version with a new effective date. Continued use of the site after changes means you accept the updated Terms.
